be referred to in these terms and conditions as "us"
and "we".
2. These terms and conditions govern the supply of goods sold by
us through our website.
3. These terms and conditions set
out the rights and obligations that apply where we supply
goods to you. Please read them carefully before you place
your order as you will be bound by these terms and conditions should
we accept your order. If you have any questions regarding these terms
and conditions, or our website or order form, please raise them by
contacting us before you place your order.
4. These terms and conditions
are governed by and were written in accordance with British
law, and may be subject to change without any prior notice
to you. However, after an order is placed, we will not change the terms
and conditions relating to that order.
5. These terms and conditions
do not affect your statutory rights as a consumer.
Contract
1. By submitting your order to us you agree to be bound
by the latest terms and conditions, enforced at the time
of the order.
2. To order from us you agree that:

You are over 16 years of age
2. You are not registered
blind or partially sighted
3. You have had an eye
examination within the last 24 months and that your
prescription is less than two (2) years old
4. You have
input your prescription details correctly
5. Your prescription
spherical power lies between +/-8.00 dioptres and
cylindrical power of +/-4.00 dioptres
6. Unless otherwise
stated by you in your order, you accept a PD measurement
of 63mm.
3. Once we have accepted your order and
payment has been received, a legally binding contract
will exist between you and us.
4. We may assign or
subcontract the contract or any part of the contract
to any person, company or firm
5. The contract is personal
to you. Nobody other than you will be able to benefit
from this contract. You may not transfer your rights
or the benefit of any of the provisions of this contract
to any other person without our prior written consent.
6.
We will meet our responsibilities under this contract
within a reasonable time unless it is impossible
for us to do this
because of circumstances beyond our control. In particular
we will not be responsible for delays caused
by our suppliers
Right to Cancel
You may cancel your contract with
us up to seven (7) days from placing your order or up
until any order has been despatched by us, which
ever is the lesser. This right to cancel does not apply
to prescription glasses at any time after we have
started to glaze/manufacture prescription lenses for
you. To cancel your contract you must notify us in writing.
If you have received the goods before your right to cancel
your contract has passed, we may still allow cancellation
but the goods must be returned to us, at your cost
and in the condition which they were in when they were
despatched to you. If this is not the case we are
unable to offer any refund. It is your responsibility
to ensure that all goods to be returned are packaged in
a suitable material to ensure their safe delivery. Any
goods that are returned in accordance with the terms and
conditions stated and accepted for refund will be refunded in full
subject to a £10 re-stocking
and handling charge per
frame.
Goods and Services
1. The description of our goods
is as set out on our website. We will endeavour
to ensure that there are no changes to these goods, but
it is possible that there could be some variations to
the goods by way of manufacturers changing the specifications
of the parts they supply to us.
2. All goods are
subject to availability. We will inform you by phone
or email or both, within 28 days of the order being placed,
if an item ordered by you is unavailable.
3.
By submitting your order to us you agree that all information
you submit is valid and true. You agree that the prescription
information you enter is exactly the same as the information
on the prescription given to you by a registered
optician. We will not be held responsible for any errors
made by you when inputting your prescription details.
4.
A scratch resistant coating on a lens resists surface
scratches from day to day wear but does not prevent them.
We will not be liable if a lens becomes scratched even if a scratch
resistant coating has been applied.
5. All frames,
lenses and coatings are covered under the manufacturers
warranty and we will replace them should a defect occur
provided they are returned within the timescale allowed
by the manufacturer.
6. We will not be expected to darken
or lighten a tinted lens that has been ordered. It is
your responsibility to decide on the density (light transmission)
of a tint at the time of ordering.
7. We will refund
any money you pay to us should we be unable to supply
the requested goods
8. Goods are sold on the condition
that they are not resold to the public.
9. We have displayed
the goods we sell on our website as accurately as possible.
However, due to the nature of different monitor displays,
and different reproduction techniques of photography and
web design, we cannot guarantee any colour description is totally
accurate.
Contact Lenses
1. When ordering contact lenses
from our site you agree to send us a copy of your
current contact
lens specification
supplied by a registered Ophthalmic or contact lens
practitioner. This specification must include
the practitioners' details
(including signature), the exact specification
of your contact lenses, date of last contact
lens aftercare and an
expiry date. We will not supply your contact
lenses if we do not receive this written specification
with all these details. All monies paid to
us when ordering the contact lenses will be refunded
in full less a £10
administration charge if this specification
is not received within 28 days of your order.
We will not supply a quantity of contact
lenses greater than that determined by the
expiry date of your written specification.
2. We
will despatch the contact lenses no more
than 14 days after the order has been accepted,
subject to availability as outlined in the
"Goods
and Services" section
of these terms
and conditions. If you do not receive
your contact lenses within 21 days
of the order being accepted,
please contact us immediately.
3. You
agree to wear your contact lenses in
accordance with the advice given by your
eye care practitioner. If you
experience any
pain, discomfort or visual
problems whilst wearing your contact lenses
you agree to cease wear immediately
and seek advice from your practitioner.
4.
We will not exchange
or refund any contact
lens order unless the contact lenses
are defective as covered by the manufacturers' warranty.
Pricing and
Payment
1. The price
you pay
will be the price
stated for the chosen goods
on our website at the time of you
submitting your
order, plus the price stated
for postage and packing per item.
2. All prices include
VAT.
3. We reserve the right to amend
prices at any time without notice, but
once an order has been accepted, we
will not change the price that applies
to that order.
4. You must
pay us the full price for goods and postage
and packing when placing your
order.
5. All payments must be made in
UK

6. All payments
are
subject to authorisation and validation
from
the credit or debit
card issuer, or subject to clearance of
your
cheque if ordering by post.
If authorisation or validation is
refused by the issuer,
or your cheque does not clear, we will
not be liable for any delay or failure
to deliver.
Despatch and Delivery
1. We will send your goods by Royal Mail
First Class Post or Royal
Mail Recorder Delivery at an additional
cost as detailed on our website.

We will despatch the goods no more
than 14 days after the order has been
accepted, subject to availability
as outlined in the "Goods
and Services" section
of these terms
and conditions. If you do not receive
your goods
within 21 days of the
order being
accepted, please contact us immediately.
3. The
goods
will be sent to the delivery address
stated on the website order
form, which must be a UK address.
4. Prices exclude delivery.
Inspection
of Goods
1. Upon delivery
of the goods you should carefully
inspect them as we will not be held
responsible for damage or defects
caused by you after you have received
them. If any of the goods are lost or
damaged, please contact us immediately
using
the e-mail
address or the
telephone number on our website and
do not use the goods.
2.
Each of the goods delivered
to you will contain written confirmation
of the prescription from
which the goods were made. If the prescription
stated does
not match the prescription ordered,
please
contact
us to inform us of
the problem and do
not use the goods.
3. You
will be
liable
for any loss or damage to
the goods from the time
of delivery unless such loss or damage
is caused by our negligence.

Limitation
of our Liability
